These Terms & Conditions ("Terms") govern your access to and use of the Tenda mobile application, website and related services (together, the "Services"), operated by SEBBAK Technologies ("Tenda", "we", "us"). By creating an account or using the Services, you agree to these Terms.
This document is a general template provided for information. Please have it reviewed by a qualified lawyer before relying on it for your business.
1. Who can use Tenda
You must be at least 18 years old and able to enter into a binding contract to use Tenda. You are responsible for keeping your account details and password secure, and for all activity that happens under your account.
2. Your account
You agree to provide accurate, current information when you register, including a valid phone number. We verify phone numbers by one-time code (OTP). You may not impersonate anyone or create an account on someone else's behalf without permission.
3. Orders and marketplace
Tenda is a platform that connects customers with independent vendors (restaurants, shops, pharmacies, service providers) and delivery riders. When you place an order, you enter into a transaction with the vendor. Tenda facilitates the order, payment and delivery but is not the manufacturer or seller of the products unless clearly stated.
Vendors are responsible for the quality, safety, description and legality of the items and services they offer. Prices, availability and delivery times are estimates and may change.
4. Payments
You can pay using mobile money, card or cash on delivery where available. By placing an order you authorise us and our payment partners to charge the total amount, including item price, delivery fee, applicable taxes and any service charges shown at checkout.
5. Delivery
Delivery is carried out by independent riders. Delivery times are estimates and may be affected by traffic, weather, vendor preparation time and demand. You must provide an accurate delivery address and be reachable on your phone.
6. Cancellations and refunds
Cancellations, returns and refunds are handled in line with our Refund & Cancellation Policy, which forms part of these Terms.
7. Acceptable use
You agree not to misuse the Services, including by: breaking any law; placing fraudulent or fake orders; harassing vendors, riders or staff; interfering with the platform's operation; or attempting to access accounts or data that are not yours.
8. Vendors and riders
If you join Tenda as a vendor or rider, additional partner terms apply, including requirements around verification, conduct, payouts and service standards. You must have the necessary licences and permits to operate.
9. Intellectual property
The Tenda name, logo, app and content are owned by SEBBAK Technologies and protected by law. You may not copy, modify or distribute them without our written permission.
10. Limitation of liability
To the maximum extent permitted by law, Tenda is not liable for indirect or consequential losses, or for the acts or omissions of vendors and riders. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
11. Changes to these Terms
We may update these Terms from time to time. If we make significant changes, we will notify you through the app or by other reasonable means. Continuing to use the Services after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the Republic of Ghana, and any disputes will be subject to the jurisdiction of the courts of Ghana.
